This section describes the consent mechanism for end-users who receive SMS messages from ClosingDay.

Method A — Web Opt-In Form

Closing participants (buyers, sellers, notaries, lenders) can opt in directly by entering their phone number below. Participants added by their title agent also receive an introductory text with opt-out instructions.

Method B — Title Agent Adds Participant

A licensed title agent enters a participant's contact information into ClosingDay to coordinate a specific real estate closing. The agent certifies, by accepting ClosingDay's Terms of Service, that each participant has agreed to take part in the closing and consents to receive related SMS notifications.

Consent language shown to title agent when adding a party:

"By adding this participant, I confirm they have agreed to participate in this closing and consent to receive transactional SMS notifications from ClosingDay related to their specific closing appointment. I understand participants can reply STOP at any time to opt out."

Upon being added, the participant receives the following introductory SMS:

Program Description

ClosingDay operates a transactional SMS notification program. Messages are sent only to individuals directly involved in a specific, active real estate closing transaction. Message types include:

Closing appointment confirmations
Reschedule notifications (new date/time)
Status updates (e.g., notary en route, documents ready)
Closing cancellation alerts
Document request alerts

No marketing or promotional messages are ever sent. All messages are strictly transactional and related to the recipient's specific closing.

How Recipients Opt In

Title agent adds closing parties

A licensed title agent creates a closing in ClosingDay and enters the contact information (name, phone number, role) for each party — buyers, sellers, notaries, and lenders. By accepting ClosingDay's Terms of Service, the title agent certifies that all parties have agreed to participate in the closing and consent to receive related SMS notifications.

Participant receives first message

Upon being added, the participant receives an introductory SMS confirming their role, closing address, and scheduled time. This message includes opt-out instructions.

Participant receives updates as needed

If anything changes — a reschedule, a status update, or a cancellation — the participant receives one SMS per event. No recurring messages are sent unless the closing details change.
